Privacy Policy

Effective Date: January 1, 2026
Last Updated: May 25, 2026

Vibes AI, Inc. ("Vibes AI," "we," "us," or "our") provides MANTRA, an artificial intelligence model and related experience for voice journaling, cognitive wellness, brain readiness, and restorative audio. You can access MANTRA through the Vibes AI mobile application, AI-native devices that integrate MANTRA, Vibes AI websites (including getvibes.ai), application programming interfaces (APIs), and related online services (together, the "Services").

This Privacy Policy ("Policy") describes how we collect, use, disclose, retain, and protect personal information when you access or use the Services. It also describes your choices and rights. Because the Services involve voice, audio, wellness, device, behavioral, and health-related information, we apply heightened safeguards to sensitive data and design our practices around transparency, user control, data minimization, and responsible innovation.

At-a-Glance Summary
Summary only. The full terms of this Policy control.

  • We use sensitive data to provide and improve MANTRA. With your permissions, we use voice, device, behavioral, location, and health-related data to deliver brain readiness and cognitive wellness features, generate insights, personalize experiences, support research, improve our models, secure the Services, and develop new Vibes AI products.
  • We do not sell raw sensitive data. We do not sell raw voice recordings, identifiable consumer health data, precise geolocation, or your personal identifiers.
  • We may create and commercialize privacy-protective outputs. We may use de-identified, aggregated, pseudonymized, statistical, derived, modeled, benchmark, and research outputs to develop, validate, commercialize, license, and improve Vibes AI products, subject to law and this Policy.
  • We do not use connected health data for targeted advertising. We do not use Apple Health, Samsung Health, Health Connect, wearable data, raw voice, or identifiable cognitive wellness data for cross-context behavioral or targeted advertising.
  • You control sensitive permissions. You decide whether to grant microphone, location, notification, SMS, Apple Health, Samsung Health, Health Connect, wearable, and other permissions. You may revoke them through your device, platform, or account settings.
  • MANTRA is wellness, not medical care. The Services are intended for wellness, education, self-reflection, and cognitive wellness awareness. They are not a substitute for professional medical advice, diagnosis, or treatment, and they are not a medical device unless we say so.

1. Scope of this Policy
This Policy applies to the Services that link to or reference it, including:

  • the MANTRA AI model and any MANTRA-powered experiences;
  • the Vibes AI mobile application;
  • AI-native devices that integrate MANTRA (whether sold by Vibes AI or by a partner under a Vibes AI license);
  • Vibes AI websites, including getvibes.ai;

This Policy does not apply to third-party websites, apps, platforms, devices, or services that Vibes AI does not control. If you connect MANTRA to a third party, that third party's own terms and privacy policy also apply.

Business and developer customers. If you access MANTRA through an API or a third-party application built on the MANTRA API, the developer or business customer (not Vibes AI) is responsible for its own privacy practices and notices for the data it collects from you in its own product. Vibes AI processes data on behalf of that customer as described in the applicable API Agreement and Data Processing Addendum.

2. Data Controller and Contact
For users in the European Economic Area, the United Kingdom, or Switzerland, Vibes AI, Inc. is the controller of personal data processed under this Policy, except where Vibes AI acts as a processor on behalf of an API or business customer.

We may use this information to operate, secure, debug, and improve the API; enforce rate limits and acceptable-use rules; bill and report; investigate abuse; and develop new products. API content provided by business customers is handled in accordance with the applicable API Agreement and Data Processing Addendum.

3.7 Cookies, Pixels, SDKs, and Similar Technologies
We use cookies, pixels, SDKs, local storage, analytics tools, attribution tools, and similar technologies on our websites and in our app. They help us remember preferences, understand usage, secure the Services, measure performance, improve onboarding, and evaluate marketing. Where required (including in the EU and UK and in US states with sensitive-PI limits), we provide a cookie and consent banner with controls for non-essential cookies, targeted advertising, analytics, sale or sharing, and sensitive personal information. We do not knowingly transmit identifiable health information, raw voice data, or connected health data to advertising platforms for cross-context behavioral or targeted advertising.

3.8 Communications Information
We collect information you send to or through the Services, including emails, support requests, survey responses, feedback, voice journal entries, chat interactions, research responses, SMS opt-in and opt-out status, and communication metadata such as delivery, open, and click events.

  • Compliance and legal obligations. Comply with laws, respond to legal requests, enforce agreements, preserve records, manage disputes, and protect rights, safety, and property.
  • Corporate transactions. Evaluate or complete a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, subject to appropriate protections for sensitive data.

5. Legal Bases for EU, UK, and Swiss Users
Where the EU and UK GDPR or Swiss FADP applies, we rely on one or more of the following legal bases:

  • Performance of a contract (Article 6(1)(b)). To provide the Services you request and perform our agreements with you.
  • Consent (Article 6(1)(a)). For microphone access, connected health integrations, precise location, certain research participation, marketing communications, cookies where required, and other processing where consent is required.

  • Legitimate interests (Article 6(1)(f)). To improve and secure the Services, understand usage, prevent fraud, develop products, conduct certain analytics, communicate with users, and support business operations. Subject to a documented balancing assessment and your rights.
  • Legal obligation (Article 6(1)(c)). To comply with applicable laws and legal process.
  • Vital interests (Article 6(1)(d)). In rare cases, to protect someone's life, health, or safety.
  • Scientific research with safeguards (Article 9(2)(j), as implemented). For research and model-development activities, subject to data minimization, pseudonymization, access controls, ethics review where appropriate, and transparency.

6. Sensitive Data, Health Data, and Explicit Consent
We process sensitive information only with a lawful basis and appropriate safeguards. Sensitive information may include consumer health data, biometric data, precise geolocation, age-related data, voice-derived data, and information about wellness, cognition, mood, sleep, or physiology.

By enabling a sensitive feature, granting a device permission, connecting a third-party health source, or joining a research-contribution flow, you authorize Vibes AI to process the relevant information for the purposes described at collection and in this Policy. Where consent or explicit consent is required, we request it through a clear, just-in-time prompt before processing begins. You may withdraw consent where consent is the legal basis. Withdrawal does not affect prior processing and may limit feature availability.

7. Model Training, AI Development, and Derived Outputs
We may use information collected through the Services (including voice, speech, behavioral, device, health, and self-report data, in identifiable, pseudonymized, or de-identified form) to develop, train, fine-tune, evaluate, validate, and improve the MANTRA AI model and related machine learning models, voice biomarker systems, classifiers, embeddings, statistical models, scores, signals, benchmarks, and other AI components used in the Services or future Vibes AI products. Where required, we obtain explicit or affirmative express consent before using sensitive data for model training.

We may also create and use de-identified, aggregated, pseudonymized, statistical, derived, modeled, and benchmark data. This may include model weights, feature embeddings, normative ranges, population-level trends, usage analytics, research findings, product insights, and commercial reports that do not identify you. To the extent permitted by law, Vibes AI may use this data for any lawful business purpose, including research, product development, model training and evaluation, commercial insights, licensing, partnerships, publications, and new products. Where applicable law requires us to maintain de-identified data without attempting re-identification, we will maintain and use it in de-identified form and require recipients to do the same.

Vibes AI owns all rights in models, algorithms, derived insights, analytics, benchmarks, research outputs, and other products or services created from de-identified, aggregated, pseudonymized, statistical, derived, modeled, or benchmark data, except where prohibited by law or expressly stated in a separate written agreement.

Business and API customer inputs. Where a business or API customer submits content to MANTRA through the API, we use that content to provide the API and as permitted by the API Agreement. We do not use API customer content to train our general-purpose models without the customer's consent, except as permitted in the API Agreement or as needed for safety, abuse prevention, or legal compliance.

8. When We Disclose Information
We disclose information only as described in this Policy:

  • Service providers and processors. Hosting, cloud infrastructure, analytics, payment, communications, customer support, security, model development, research infrastructure, and professional advisors, all under written contracts that restrict their use of personal data.
  • Health and device platforms at your direction. Apple Health, Samsung Health, Health Connect, wearables, AI-native device makers, app stores, and other platforms when you authorize data flows.
  • Research partners. Universities, labs, clinical collaborators, contractors, advisors, and institutional partners under written agreements, protocols, review processes, or safeguards appropriate to the data and project.

  • API and developer customers. Where you interact with a third-party application built on the MANTRA API, we may disclose data to that customer as needed to provide the integration that you have chosen to use.
  • Legal, safety, and compliance recipients. Regulators, law enforcement, courts, counterparties, or others where disclosure is reasonably necessary to comply with law, enforce our terms, protect rights, prevent harm, or address security issues.
  • Corporate transaction participants. Parties involved in a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or similar transaction, subject to appropriate confidentiality and data-protection measures.
  • With your consent or direction. Other disclosures that you request, authorize, or consent to.

We do not sell raw voice recordings, identifiable consumer health data, precise geolocation, or your personal identifiers. If a jurisdiction defines "sale," "sharing," "targeted advertising," or "cross-context behavioral advertising" broadly enough to include certain analytics, advertising, or data transfers we conduct, we will provide the legally required notices and opt-out rights.

9. Advertising and Marketing
We may market Vibes AI products and services to you based on your account status, communication preferences, website activity, app engagement, or non-sensitive usage information, where permitted by law.

We do not use connected health data from Apple Health, Samsung Health, Health Connect, wearables, or similar health integrations for targeted or cross-context behavioral advertising. We do not disclose identifiable consumer health data, raw voice data, or sensitive cognitive wellness data to advertising platforms for targeted advertising. We do not permit advertising SDKs or pixels to access HealthKit, Health Connect, Samsung Health, or other connected-health data.

You may unsubscribe from marketing emails by using the unsubscribe link. You may opt out of SMS marketing by replying "STOP" to a marketing SMS or as otherwise instructed. Service, security, and transactional messages may still be sent where necessary to operate the Services.

10. Apple Health, Samsung Health, Health Connect, and Wearables
If you connect MANTRA to Apple Health, Samsung Health, Health Connect, a wearable, or another third-party health source, we access only the data categories you authorize through the platform's permission interface. The platform may allow you to grant, deny, or revoke permissions on a per-category basis.

We use connected health data to provide, personalize, improve, and secure the Services; to generate insights you request; to support research and product development where legally permitted and where you have consented; and to create de-identified, aggregated, pseudonymized, statistical, derived, or benchmark outputs as described in this Policy.

We do not use connected health data for targeted advertising, sell connected health data, or disclose connected health data to data brokers. If you revoke a health-integration permission, we stop collecting new information from that integration. We may retain information previously collected as described in this Policy, unless you request deletion and no legal exception applies.

11. Voice and Biometric Safeguards
MANTRA may request microphone access (on phones, AI-native devices, or web clients) to capture voice recordings, audio samples, or spoken interactions. Where required by platform rules or applicable law, we provide a clear permission prompt and a visual or audible indicator when recording is active.

We treat raw voice recordings as sensitive data. We do not sell raw voice recordings. We do not share raw voice recordings with unaffiliated third parties except (i) with your consent, (ii) with service providers or research partners under written safeguards, (iii) as legally required, or (iv) as otherwise described in this Policy.

If we use voice-derived data in a way that is considered a "biometric identifier," "biometric information," "voiceprint," or "biometric data" under applicable law (including the Illinois Biometric Information Privacy Act, Texas CUBI, and Washington biometric law), we will comply with required notice, written or electronic release, retention schedule, deletion, disclosure, and security obligations.

12. Data Retention
We retain information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain accounts, comply with law, resolve disputes, enforce agreements, support research integrity, improve models, maintain security, and preserve legitimate business records.

Retention periods vary by data category:

  • account and contact data: while your account is active and for a reasonable period after deactivation, subject to legal holds;
  • voice recordings and other raw sensitive data: for the period disclosed at collection or as needed for the feature, research program, model-development purpose, legal obligation, or consented retention period (and, where applicable, no longer than the period required by biometric retention laws);
  • connected health data: while your account or integration is active and for a reasonable period afterward, unless deletion is requested and no exception applies;
  • API logs and integration metadata: for the period needed to operate, secure, bill, and improve the API and to investigate abuse;
  • de-identified, aggregated, pseudonymized, statistical, derived, modeled, or benchmark data: retained for longer periods, including indefinitely where permitted by law, under appropriate safeguards and contractual re-identification prohibitions;
  • transaction and compliance records: retained as required or permitted by law.

When information is no longer needed, we will delete, de-identify, aggregate, or otherwise handle it in accordance with applicable law and our retention practices.

13. Security
We use administrative, technical, and organizational safeguards designed to protect personal information, including access controls, encryption in transit and (where appropriate) at rest, secure development practices, monitoring, vendor risk review, data minimization, employee confidentiality obligations, and incident response procedures. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

If we discover a security incident involving your information, we will assess the incident and provide legally required notifications. For consumer health data, this may include the FTC Health Breach Notification Rule, applicable state breach laws, and the EU and UK GDPR breach-notification rules.

14. Your Choices
Depending on your location, device, and feature use, you may have the following choices:

  • opt out of sale, sharing, or targeted advertising where legally available;
  • limit certain uses of sensitive personal information where legally available;
  • withdraw consent where consent is the legal basis; and
  • object to or restrict certain processing where legally available.

15. US State Privacy Rights
Depending on your state of residence and whether the applicable law applies to Vibes AI, you may have rights to know, access, confirm processing, correct, delete, obtain a portable copy, opt out of sale, opt out of sharing or targeted advertising, opt out of certain profiling that produces legal or similarly significant effects, limit the use and disclosure of sensitive personal information, appeal a privacy-request decision, and be free from unlawful discrimination for exercising your privacy rights.

California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA and CPRA"). Sensitive personal information under CPRA may include precise geolocation; racial or ethnic origin; religious or philosophical beliefs; union membership; the contents of mail, email, and text messages not directed to the business; genetic data; biometric information processed to uniquely identify a consumer; personal information collected and analyzed concerning health; and personal information collected and analyzed concerning sex life or sexual orientation. You may exercise applicable rights, including the right to limit the use and disclosure of sensitive personal information, where available.

To exercise rights, contact privacy@getvibes.ai. We may need to verify your request. Authorized agents may submit requests where permitted by law. We will not retaliate against you for exercising privacy rights.

16. Washington and Other Consumer Health Data Rights
If you are a Washington consumer, or a consumer in another jurisdiction with a comparable consumer-health-data statute (including Nevada SB 370 and Connecticut's health-data amendments), the following supplemental disclosures apply to "consumer health data" as defined by those laws.

16.1 Categories of Consumer Health Data Collected
Vibes AI may collect the following categories of consumer health data: self-reported mood, stress, focus, energy, sleep, symptoms, lifestyle, and session feedback; brain readiness, resilience, and similar wellness scores and inferences; voice-derived signals used to generate cognitive wellness insights; data imported with your permission from Apple Health, Samsung Health, Health Connect, or wearables (such as heart rate, heart rate variability, sleep, activity, respiratory, cycle, and mindfulness data); and inferences derived from any of the foregoing.

We use consumer health data to provide and personalize the Services, generate insights, conduct research and model development, develop new Vibes AI products, maintain security and integrity, and comply with legal obligations.

16.3 Sharing of Consumer Health Data
We share consumer health data only with service providers and processors acting on our behalf, with research partners under written agreements, at your direction (including with health platforms), or as required by law. We do not sell consumer health data, and we do not use consumer health data for targeted advertising.

16.4 Your Rights with Respect to Consumer Health Data
You may request to (i) confirm whether we collect, share, or sell your consumer health data; (ii) access your consumer health data; (iii) withdraw consent to our collection or sharing of your consumer health data; and (iv) delete your consumer health data. To exercise these rights, contact privacy@getvibes.ai. You also have the right to appeal a denial of these rights.

17. EEA, UK, and Swiss Privacy Rights
If you are in the EEA, UK, or Switzerland, you may have the right to request access, rectification, erasure, restriction, portability, objection (including objection to processing based on legitimate interests), withdrawal of consent, and review of decisions based solely on automated processing that produce legal or similarly significant effects. You may also have the right to lodge a complaint with your local data protection authority.

Where we rely on consent or explicit consent, you may withdraw consent at any time without affecting the lawfulness of processing before withdrawal. Where we rely on legitimate interests, you may object to processing, and we will assess the objection under applicable law.

18. International Data Transfers
Vibes AI is based in the United States. Information may be processed in the United States and other countries that may not provide the same level of data protection as your home country. Where required, we use appropriate transfer mechanisms, including adequacy decisions, the EU-U.S. Data Privacy Framework (if Vibes AI self-certifies and is listed), Standard Contractual Clauses (current modules, where applicable), the UK International Data Transfer Addendum, the Swiss addendum to the SCCs, and Transfer Impact Assessments. You may request a copy of the transfer safeguards we rely on by contacting [privacy@getvibes.ai].

19. Children and Minors
The Services are intended for users who are at least 18 years old, unless Vibes AI expressly provides a separate youth experience with legally appropriate parental or guardian consent and safeguards. We do not knowingly collect personal information from children under 13, and we do not knowingly process sensitive data from minors where prohibited by law. If you believe a child has provided information to us, contact privacy@getvibes.ai so we can investigate and take action.

20. Automated Processing and AI-Generated Insights
MANTRA uses automated processing, machine learning, and AI systems to generate scores, trends, recommendations, classifications, predictions, and other outputs from your voice, behavioral, device, location, and health-related data. These outputs are intended for wellness, education, self-reflection, and cognitive wellness awareness. They are not medical diagnoses, clinical recommendations, or decisions with legal or similarly significant effects, unless we expressly state otherwise and meet applicable legal and regulatory requirements.

Consistent with widely adopted responsible-AI standards, we restrict use of the Services for high-risk decisions affecting access to healthcare, employment, education, housing, credit, insurance, or legal rights without appropriate human and professional review. We do not use the Services to make inferences about a person's identity, immigration status, religious beliefs, sexual orientation, or other sensitive characteristics from voice or other signals, except where you have provided that information directly.

21. Third-Party Services, Devices, and Links
The Services may link to, integrate with, or run on third-party services, devices, or platforms. Vibes AI does not control those third parties, and their privacy practices are governed by their own policies. Review the privacy notices of any third-party services, devices, or apps you connect to MANTRA.

22. Changes to this Policy
We may update this Policy from time to time. If we make material changes, we will provide notice as required by law, such as by updating the effective date, posting a notice in the Services, sending an email, or providing an in-app notification. If we materially expand how we use sensitive data, we will obtain additional consent where legally required.
